1. Introduction

Welcome to Soft Compass. These Terms and Conditions ("Terms") govern your use of the Soft Compass website located at softcompass.sbs (the "Site") and the travel services offered by Soft Compass ("Services").

By accessing the Site, booking a tour, or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Site or use our Services.

Soft Compass is a registered company (Company No: 35339676) with its registered office at 760 Jane Cove, Edwardbury, ST16 3AP, United Kingdom.

2. Definitions

Throughout these Terms, the following definitions apply:

  • "Agreement" means the contract between you and Soft Compass for the provision of the Services.
  • "Booking" means the reservation of travel services through Soft Compass.
  • "Confirmation" means the written confirmation of your Booking issued by Soft Compass.
  • "Departure Date" means the date on which your tour or travel service is scheduled to begin.
  • "Force Majeure" means unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised.
  • "Services" means the travel services provided by Soft Compass, including but not limited to tours, accommodations, transportation, and activities.
  • "You" or "your" means the person who makes a Booking and all persons named on the Booking (including anyone who is added or substituted at a later date).
  • "We," "us," or "our" means Soft Compass.

3. Booking Process and Payment

3.1 Making a Booking

To make a Booking, you must:

  • Be at least 18 years of age or have the consent of a parent or guardian
  • Provide accurate and complete information for all travelers in your party
  • Pay the required deposit or full payment as specified at the time of booking
  • Accept these Terms on behalf of all members of your party

3.2 Booking Confirmation

A contract between you and Soft Compass is formed when we issue a Confirmation. The Confirmation will include essential details such as itinerary, inclusions, exclusions, and payment schedule. It is your responsibility to review the Confirmation and inform us immediately of any errors or discrepancies.

3.3 Payment Terms

Unless otherwise specified in your Confirmation:

  • A non-refundable deposit of 20% of the total tour price is required at the time of booking
  • The balance payment is due 60 days before the Departure Date
  • For bookings made within 60 days of the Departure Date, full payment is required at the time of booking
  • Failure to make payments by the due dates may result in cancellation of your Booking and forfeiture of any payments made

3.4 Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, MasterCard, American Express)
  • Debit cards
  • Bank transfers
  • PayPal

All payments must be made in the currency specified in your Confirmation. You are responsible for any bank charges or currency conversion fees.

3.5 Price Guarantee and Surcharges

The price of your tour is guaranteed once we have issued your Confirmation and received your deposit. However, we reserve the right to impose surcharges in the following circumstances:

  • Transportation costs (including fuel) increase
  • Government-imposed taxes or fees relevant to your tour increase
  • Exchange rates relevant to your tour fluctuate significantly

If a surcharge is necessary, we will notify you at least 30 days before your Departure Date. If the surcharge exceeds 10% of your total tour price, you may cancel your Booking and receive a full refund. You must notify us of your intention to cancel within 14 days of receiving the surcharge notice.

4. Cancellations and Changes

4.1 Cancellation by You

You may cancel your Booking at any time by providing written notice to us. Cancellation fees will apply as follows:

We strongly recommend purchasing travel insurance to protect against cancellation penalties.

4.2 Changes by You

If you wish to make changes to your Booking after Confirmation, we will make reasonable efforts to accommodate your request, subject to availability and the following conditions:

  • All change requests must be made in writing
  • An administration fee of £50 per person will apply to each change
  • Additional costs incurred as a result of the change will be charged to you
  • Changes requested within 30 days of the Departure Date may be treated as a cancellation and rebooking, subject to cancellation fees

4.3 Transferring Your Booking

If you are prevented from traveling, you may transfer your Booking to another person, provided that:

  • You notify us in writing at least 30 days before the Departure Date
  • The transferee meets all conditions applicable to the tour
  • An administration fee of £100 per person is paid
  • Any additional costs incurred due to the transfer are paid

You and the transferee will be jointly and severally liable for all payments due.

4.4 Cancellation by Us

We reserve the right to cancel your tour in the following circumstances:

  • Insufficient participants to operate the tour (you will be notified at least 30 days before the Departure Date)
  • Force Majeure events (as defined in Section 10)
  • Your failure to pay the balance by the due date
  • Your failure to comply with these Terms

If we cancel your tour (except due to your failure to comply with these Terms or pay the balance), you will receive a full refund of all monies paid or, where possible, be offered an alternative tour of comparable standard.

4.5 Changes by Us

We may need to make changes to your tour due to circumstances beyond our control. Changes are classified as follows:

  • Minor Changes: Changes that do not significantly affect the nature or quality of your tour. We will inform you of minor changes, but we are not obligated to pay compensation.
  • Significant Changes: Changes that significantly affect the nature or quality of your tour, such as a change of accommodation to a lower standard or a significant change to the itinerary. If we make a significant change, we will inform you as soon as possible and offer you the choice of:
    • Accepting the change
    • Taking an alternative tour of comparable or higher standard (if available)
    • Canceling your tour and receiving a full refund

If you choose to accept a significant change or take an alternative tour of lower standard, we will refund the price difference. If you accept a tour of higher standard, you will pay the price difference.

5. Travel Documents and Requirements

5.1 Passports and Visas

You are responsible for ensuring that you and all members of your party have:

  • Valid passports (with at least six months validity beyond your return date)
  • Necessary visas for all countries on your itinerary
  • Any required travel authorizations (such as ESTA for the USA or ETA for Canada)

We will provide general information about passport and visa requirements, but it is your responsibility to verify this information with the relevant embassies or consulates. We are not liable for any costs, delays, or denied entry resulting from incorrect or missing travel documents.

5.2 Health Requirements

You are responsible for:

  • Ensuring you are aware of all recommended vaccinations and health precautions for your destination
  • Obtaining any necessary vaccinations or medications
  • Disclosing any pre-existing medical conditions that may affect your ability to participate in the tour

We recommend consulting your doctor or a travel health specialist at least eight weeks before your departure.

5.3 Travel Insurance

Travel insurance with comprehensive coverage is mandatory for all of our tours. Your insurance must cover:

  • Emergency medical expenses and repatriation
  • Cancellation and curtailment
  • Personal liability
  • Loss of luggage and personal effects

You must provide proof of adequate insurance coverage before your Departure Date. If you fail to provide proof of insurance, we reserve the right to cancel your Booking without refund.

6. During Your Tour

6.1 Tour Leaders and Local Guides

Our tour leaders and local guides have the authority to make decisions that affect the safety, well-being, and enjoyment of all travelers. You must comply with their reasonable instructions at all times. Failure to do so may result in your removal from the tour without refund.

6.2 Behavior and Conduct

You are expected to behave in a manner that does not cause distress, danger, or annoyance to others. This includes respecting local customs, laws, and regulations. We reserve the right to terminate your participation in the tour without refund if:

  • Your behavior endangers yourself or others
  • You break local laws
  • You consistently disregard the instructions of your tour leader
  • You are abusive to our staff, suppliers, or other travelers

In such cases, you will be responsible for arranging your own return transportation and any associated costs.

6.3 Accommodation

The accommodation specified in your Confirmation will be provided whenever possible. However, we reserve the right to substitute alternative accommodation of a similar or higher standard if necessary. Room assignments and specific requests (such as adjoining rooms) cannot be guaranteed but will be accommodated when possible.

6.4 Transportation

Transportation will be provided as specified in your Confirmation. We reserve the right to substitute alternative modes of transportation if necessary. Schedules are subject to change due to weather, traffic, or other conditions beyond our control.

6.5 Itinerary Changes During the Tour

We reserve the right to modify the itinerary during the tour due to weather, road conditions, or other circumstances beyond our control. Our tour leaders will make reasonable efforts to provide alternative activities of similar interest and quality.

6.6 Special Requirements

If you have special dietary requirements, mobility limitations, or other special needs, you must inform us at the time of booking. We will make reasonable efforts to accommodate your requirements, but we cannot guarantee that all requests can be met.

7. Complaints and Claims

7.1 During Your Tour

If you have a complaint during your tour, you must inform your tour leader or our local representative immediately, giving them the opportunity to resolve the issue on the spot. If the issue cannot be resolved to your satisfaction, you should obtain written documentation from the tour leader or local representative, including details of the complaint and any actions taken.

7.2 After Your Tour

If your complaint is not resolved during your tour, you must submit a formal written complaint to us within 28 days of the end of your tour. Your complaint should include:

  • Your booking reference number
  • The specific details of your complaint
  • Any documentation obtained during the tour
  • The resolution you are seeking

We will acknowledge your complaint within 14 days and provide a full response within 28 days. If we need more time to investigate, we will keep you informed of our progress.

7.3 Limitation of Claims

We cannot accept liability for any claims not notified to us in accordance with this section. Any legal action arising from the Agreement must be commenced within two years from the end of your tour.

8. Our Liability to You

8.1 Our Obligations

We will arrange and provide the Services as described in your Confirmation with reasonable skill and care. We accept responsibility for any loss or damage you suffer as a result of our negligence or failure to perform our obligations under the Agreement.

8.2 Limitations of Liability

Our liability is limited as follows:

  • We are not liable for any loss, damage, injury, illness, death, or other claim arising from:
    • Your own acts or omissions
    • The acts or omissions of third parties not connected with the provision of your tour
    • Unusual or unforeseeable circumstances beyond our control
    • Force Majeure events (as defined in Section 10)
  • Our liability for claims not involving personal injury, illness, or death is limited to twice the cost of your tour
  • Our liability for services provided by third-party suppliers (such as airlines, hotels, or activity providers) is limited to the extent of their liability under international conventions and the relevant laws of their country

8.3 International Conventions

Our liability is limited in accordance with the following international conventions:

  • The Warsaw Convention 1929 (as amended) for international travel by air
  • The Athens Convention 1974 for travel by sea
  • The Berne Convention 1961 for travel by rail
  • The Paris Convention 1962 for accommodation providers

8.4 Adventure Travel

Many of our tours involve activities that carry inherent risks. By booking such tours, you accept these risks. We will take reasonable precautions to ensure your safety, but we cannot eliminate all risks associated with adventure travel. You must:

  • Follow all safety instructions provided by your tour leader or activity provider
  • Use any safety equipment provided
  • Inform us of any pre-existing medical conditions that may affect your ability to participate
  • Acknowledge that adventure activities may not be suitable for everyone

9. Your Obligations to Us

9.1 Accuracy of Information

You are responsible for providing accurate and complete information for all travelers in your party, including:

  • Full names as they appear on passports
  • Passport details and nationality
  • Date of birth
  • Special requirements (dietary, medical, mobility)
  • Emergency contact information

Inaccurate information may result in additional costs, delays, or denied boarding/entry.

9.2 Health and Fitness

You must ensure that all members of your party:

  • Are physically and mentally fit to undertake the tour
  • Have disclosed any pre-existing medical conditions that may affect their participation
  • Have consulted a doctor before booking if they have any concerns about their ability to participate

We reserve the right to request a doctor's certificate confirming fitness to travel.

9.3 Respect for Local Customs

You must respect the customs, laws, and regulations of the countries you visit. This includes:

  • Dressing appropriately, especially when visiting religious sites
  • Being mindful of local attitudes toward alcohol consumption
  • Avoiding behavior that may be considered offensive or disrespectful

9.4 Sustainability and Responsible Tourism

We are committed to sustainable and responsible tourism. You agree to:

  • Minimize your environmental impact
  • Respect wildlife and natural habitats
  • Support local businesses where possible
  • Avoid purchasing products made from endangered species or ancient artifacts

10. Force Majeure

We will not be liable for any failure to perform our obligations or delays in performance due to Force Majeure events. Force Majeure events include, but are not limited to:

  • War, threat of war, riot, civil strife, or terrorist activity
  • Natural or nuclear disaster
  • Fire or adverse weather conditions
  • Epidemics, pandemics, or quarantine restrictions
  • Industrial disputes or strikes
  • Technical problems with transportation
  • Closure or congestion of airports or ports
  • Government action or travel restrictions
  • Any other circumstances beyond our reasonable control

If Force Majeure events prevent us from providing your tour as planned, we will:

  • Notify you as soon as possible
  • Make reasonable efforts to offer alternative arrangements
  • If no suitable alternatives are available, provide a refund of all monies paid minus any non-recoverable expenses already incurred

11. Data Protection and Privacy

We collect and process your personal information in accordance with our Privacy Policy, which can be found at Privacy Policy. By accepting these Terms, you acknowledge that you have read and understood our Privacy Policy.

You consent to our sharing your personal information with third parties (such as airlines, hotels, and local operators) as necessary to fulfill our obligations under the Agreement.

12. Photography and Testimonials

During your tour, we may take photographs or videos for promotional purposes. By participating in our tours, you grant us permission to use such images in our brochures, website, social media, and other promotional materials without compensation to you.

If you do not wish to be photographed or filmed, please inform your tour leader at the beginning of the tour.

We may also request testimonials from you after your tour. By providing a testimonial, you grant us permission to use it in our promotional materials with attribution to your first name and last initial, unless you specify otherwise.

13. Intellectual Property

All content on our Site, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Soft Compass or its content suppliers and is protected by international copyright laws.

You may not reproduce, modify, distribute, or republish any content from our Site without our prior written consent.

14. Links to Third-Party Websites

Our Site may contain links to third-party websites. These links are provided for your convenience and do not imply endorsement of the content or services provided by these websites. We are not responsible for the content, accuracy, or practices of third-party websites.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Amendments to These Terms

We reserve the right to amend these Terms at any time. The amended Terms will be effective immediately upon posting on our Site. Your continued use of our Site or Services after the posting of amended Terms constitutes your acceptance of the changes.

For existing bookings, the Terms in effect at the time of booking will apply, unless the amendments are required by law or government regulation.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

For EU consumers, this does not affect your rights under the mandatory consumer protection laws of your country of residence.

18. Entire Agreement

These Terms, together with your Confirmation and our Privacy Policy, constitute the entire agreement between you and Soft Compass regarding your tour and supersede all prior communications, representations, or agreements, whether oral or written.
